By ordering a commission from me, user leenanightmare ("the Artist"), you ("the Client") affirm to have read and agree to the Terms of Service listed below. Failure to abide by the Terms of Service may result in a rejected or cancelled commission with or without a refund, depending on the situation. Please note that these Terms of Service may be subject to change without prior notice, but a changelog will be provided once this occurs.
 
SECTION 1: General
 
☆ I have a right to refuse the commission for whatever reason, with or without explanation.
 
☆ I have a right to cancel the commission for whatever reason, with or without explanation.
 
☆ The Client has a right to cancel the commission for whatever reason, with or without explanation.
 
☆ The Client is permitted to request my e-mail address for the purpose of the commission.
 
☆ I have a right to upload the commission on any/all social media (including but not limited to Discord, Twitter, Toyhouse, Ko-fi) unless specified by the Client beforehand to keep the commission private.
 
☆ Payment is to be made before the Client has requested their commission type. Sketch(es) will be sent. The commission will be on an "on hold" status if payment hasn’t been received for whatever reason.
 
☆ I will work with deadlines or rush orders if needed. However if I can’t make it happen then I’ll refund or take my time.
 
☆ I don’t work on a "first come first serve" basis. But to be expected, smaller commissions are worked on first while bigger ones are saved for last.
 
☆ The Client may contact me at any time to ask for a progress check on the commission, but no spams or everyday asks. The Client is encouraged to contact me via social media (Discord, Twitter, Toyhouse) if the Client is unable to reach me through via e-mail.
 
Section 2: Image Rights
 
☆ The Client may make minor edits to the completed commission (ex. cropping, adding text/borders, changing brightness/contrast/hue/saturation.)
 
☆ The Client may use / re-upload the commission for personal/non-commercial use, but only with proper credit to me and a linkback to any of my social media (Twitter, Toyhouse etc) is provided.
 
☆ If the commission includes characters that do not belong to the Client, additional credit to the owner(s)/creator(s) of said characters must be provided when using/re-uploading for personal/ non-commercial use.
 
☆ The Client may not use the commission for any commercial use unless discussed with me beforehand.
 
☆ Commissions for commercial use will be charged more than personal/non-commercial commissions. Prices are negotiable.
 
☆ If the commission includes characters that do not belong the Client, the Client can not use the commission for commercial use unless explicitly having written permission from the owner(s)/creator(s) of said characters is provided to the Artist in the form of direct communication. This only applies to the art that the Artist has directly drawn for the Client. Sold characters and designs may be used for commercial use as long as it is not the Artist's work.
 
☆ The Client may not claim the commission as their/his/her own work, whether she/they/he did or did not make any edits to the commission.
 
☆ I do not claim ownership to any of the characters/subjects portrayed in the commission. Characters belong to their respective creator(s).
 
☆ When it comes to adopts, I do not care what you do with them after the adopt has been bought so long as I’m credited.
 
Section 3: Delivery / Turnaround
 
☆ All commissions that are done digitally:1. There will be no hard copies.
2. The Client is paying for a service/digital good and will not require any shipping of any kind.
 
☆ All commissions that are done traditionally:1. Will be sent via a high quality picture.
2. If asked the traditional piece will be mailed to the Client but if you wish to have it as a picture then that’s fine as well, but shipping costs can be discussed and any other information.
 
☆ The Client may ask for a specific canvas size for the commission.
 
☆ Commissions with a canvas size smaller than the original is gonna look smaller which may result in losses to detail and/or quality.
 
☆ The Client may ask for the commission to be changed if the Client plans to personally print the commission.
 
☆ All commissions will be sent via a pre-negotiated delivery method (e-mail, Discord, etc.) with the completed commission.
 
☆ Unless specified not to upload the commission to the public, all commissions will be posted on my social media, resized and/or watermarked.
 
☆ Commissions will be posted on my social media after the Client has received and approved the original and unmarked commission file.
 
☆ The Client may choose to remain anonymous when I publicly upload the commission.
 
☆ Depending on the commission type, the estimated turnaround is about one 1 week to a few days, however things change and it could be a month.
 
☆ If I have to take longer than three months to complete the commission for whatever reason, the Client will be contacted and informed of the status of their commission.
 
Section 4: Payment
 
☆ I prefer payment first. However, if you as the client wish, I can start up a sketch and then be sent the money.
 
☆ I take every and almost all types of payment, CAD is most preferred but if your currency is different from mine you just have to put the price of the commission into a currency generator.
 
☆ Payment is to be done using e-transfer or through email since I use my bank to take payments.
 
☆ Depending on the currency I take online currencies, my main includes deviant art points.
 
☆ I don’t take cryptocurrency or NFTs.
 
☆ Payment must be sent within 24 hours after confirmation.
 
Section 5: Refunds
 
☆ If the Client cancels the commission for whatever reason, the Client will receive a refund, depending on how much of the commission has been finished. As follows:
 
1. If just started I will give a full refund2. If partially or halfway done I will give a half refund3. If the piece is completed but has been cancelled last moment there will not be a refund but I will give you the piece anyway and not dispose of it.
 
☆ If I cancel the commission for whatever reason, the Client will receive a full refund, in addition to a picture of whatever progress of the commission has been completed.
 
☆ Refunds will be given within 24 hours after correspondence.
 
☆ If the Client is unsatisfied with the commission, the Artist is willing to discuss and make minor edits (ex. adjusting colours, length of hair, etc). Any desired major revisions (ex. reposing, entire colour scheme change, etc.) can be negotiated.
